How to Run a Fair Oral Exam Over Video
An online oral exam is the most reliable way to confirm that a student understands their own work. It also tempts teachers to improvise. A consistent format keeps it fair.
- Publish the format in advance. Tell students the length, the number of questions, the rubric and what happens if the connection drops. Anxiety falls when the rules feel predictable.
- Build a question bank with variants. Write three or four versions of each question so students who go later gain nothing from those who go first.
- Keep sessions short. For a school-age check on a project, 5-10 minutes usually covers two or three probing questions. Leave a buffer between students for notes.
- Verify identity without a room scan. Have students join from their school account or show a student ID to the camera. Skip bedroom scans; the legal section below explains why.
- Set the room rules before students join. Turn off chat and participant screen sharing unless the task needs them. In a language exam, switch off live translation. In a science or history exam, translated instructions can remove a language barrier that has nothing to do with the content.
- Follow your school's recording policy. Check whether your school requires notice or consent before you record a minor. If you do not record, take rubric notes during the session, or invite a second teacher for high-stakes grades.
- Plan for technical failure. Decide in advance that a dropped call means the student rejoins and continues, or reschedules without penalty. Never let bandwidth decide a grade.
- Score right away. Fill in the rubric within a minute of the call ending, before the next student blurs your memory.
Academic Integrity When Every Student Has a Chatbot
The AI era did not create cheating, but it changed its cost. A systematic review of 19 studies with 4,672 participants found that 44.7% of university students self-reported cheating in online exams. That figure was 29.9% before COVID-19 and 54.7% during the pandemic, and the most common reason students gave was simply that the opportunity existed (Newton and Essex, 2023). The authors also note that survey designs probably under-report cheating.
AI also changes what homework success means. In a randomized trial with nearly 1,000 high school math students in Turkey, students who practiced with a standard GPT-4 chat assistant scored 48% higher on practice problems. Once access was removed for the exam, the same group scored 17% lower than students who never had access (Bastani et al., 2025). Assisted performance and independent performance are different things, and your assessment design has to tell them apart.
Good online assessment design removes much of that opportunity. Four patterns hold up well:
- Grade the process. Collect a proposal, a draft and a final version. Ask for a two-minute voice memo explaining one decision the student made.
- Anchor tasks in local context. Use your class data, a school event or a discussion from last Tuesday. A generic chatbot has no access to any of it.
- Add a live component. Pair every major written task with a short oral follow-up for a random sample of students, or for everyone if class size allows.
- Make AI rules explicit per task. State whether AI is banned, allowed for brainstorming only, or allowed with disclosure. Students cannot follow a rule you never stated.
Why AI detectors should not decide a grade
AI text detectors look like a shortcut. Evidence says to treat them with care. Stanford researchers ran seven widely used GPT detectors on 91 essays written by non-native English speakers for the TOEFL. The detectors labeled more than half of these human-written essays as AI-generated, with an average false-positive rate of 61.3% (Liang et al., 2023). The same detectors classified US eighth-grade essays accurately.
The implication for multilingual classrooms is serious. A detector score alone can push you to accuse precisely the students who already work hardest to write in a second language. Use a flag as a reason for a conversation, and let an oral follow-up settle the question.
The Proctoring Question: Evidence, Bias and Legal Risk
Remote proctoring does appear to reduce cheating, though the evidence base is thin; the Newton and Essex review describes the data as limited. The trade-offs, on the other hand, are well documented.
Bias. A 2022 study examined automated proctoring flags for about 357 students across four courses at a US university. Students with darker skin tones and Black students were significantly more likely to be flagged for instructor review, and women with the darkest skin tones were flagged far more often than other groups (Yoder-Himes et al., 2022). Facial detection that fails on some faces turns a neutral tool into an unequal one.
Legal risk in the US. In 2022, a federal district court in Ohio ruled that a public university's pre-exam webcam scan of a student's bedroom was unreasonable under the Fourth Amendment in Ogletree v. Cleveland State University. An appeals court later ordered the case dismissed after the student's death, so the ruling sets no binding precedent (Bloomberg Law, 2023). Still, the reasoning gives public institutions a clear warning about mandatory room scans without an alternative.
Regulation in the EU. The EU AI Act classifies AI systems that monitor and detect prohibited student behavior during tests as high-risk, and it has banned emotion recognition in education institutions since February 2025. After the 2026 Digital Omnibus amendment, the high-risk rules for education apply from 2 December 2027 (European Commission). Courts already set limits: in 2025, a German state appeals court ordered a university to pay damages because facial recognition in a remote exam processed biometric data without valid consent (Thuringian Higher Regional Court, 3 U 885/24).
If an online assessment still needs proctoring, reduce the footprint. Offer an in-person or oral alternative, avoid room scans, explain what the software records and who sees it, and have a human review every flag before anyone raises it with a student.
Fairness, Accessibility and Multilingual Learners
A fair online assessment measures the skill you intend to measure, not a student's bandwidth, device or home language.
Accessibility. Build accommodations into the platform: extended time settings, screen reader support and captions. US public schools and universities also face a legal deadline. The Department of Justice's 2024 rule under Title II of the ADA adopted WCAG 2.1 Level AA for web content, and an April 2026 interim final rule moved compliance to April 26, 2027 for public entities serving 50,000 people or more, and to April 26, 2028 for smaller ones (Federal Register, 2026). Content a school provides through a vendor, including online tests, generally falls inside that scope.
Connectivity and devices. Give a time window rather than a single start minute, allow phone submissions for recorded responses, and publish a no-penalty rule for technical failures.
Multilingual learners. English learners made up 10.6% of US public school students in fall 2021, about 5.3 million students, and 20.2% in Texas (NCES). For them, a math or science test written in dense English partly becomes a reading test. Separate the two goals. In content subjects, plain-language questions, glossaries and translated instructions remove noise. In language classes, the language itself is the skill, so translation stays off. Privacy. Before adopting any tool, check how it handles student records under FERPA, and whether it collects personal information from children under 13.
